RENTAL TERMS & CONDITIONS

Houston Fan Rentals, LLC

These Rental Terms & Conditions (“Terms”) govern the rental of equipment from Houston Fan Rentals, LLC (“we,” “us,” or “our”). By placing an order through https://houstonfanrentals.com, accepting a written or emailed custom quote (including by reply of “I accept” or by signing the quote), and/or signing for delivery of the equipment, you agree to these Terms.

1. Rental Agreement

When you complete a rental order or accept a custom quote, you enter into a binding agreement with Houston Fan Rentals, LLC to rent the equipment for the selected period under these Terms. The equipment remains the sole property of Houston Fan Rentals, LLC at all times.

2. Rental Period

  • The rental period begins on the scheduled delivery/setup date and ends on the scheduled pickup date.
  • Daily rentals are for a 24-hour period unless otherwise stated.
  • Weekly rentals are for 7 consecutive days.
  • Early returns do not entitle you to a refund for unused days.

3. Delivery, Setup & Pickup

  • Houston Fan Rentals, LLC provides delivery, professional setup, basic operating instructions, and scheduled pickup as part of the rental (subject to the delivery fees shown at checkout).
  • You must ensure reasonable access to the delivery location and that someone 18 years or older is present to accept the equipment and receive instructions.
  • If we are unable to complete delivery or pickup due to lack of access, incorrect address, or no one present, additional fees may apply and the rental period is not extended.
  • Pickup must occur as scheduled. If the unit is not available for collection at the agreed time, additional daily charges and/or recovery fees may apply.

4. Customer Responsibilities

You agree to:

  • Use the equipment only for its intended purpose in a safe and reasonable manner.
  • Follow all operating instructions provided by Houston Fan Rentals, LLC.
  • Protect the equipment from damage, theft, and unauthorized use.
  • Not move the equipment from the delivery location without our prior written approval.
  • Not make any modifications, repairs, or alterations to the equipment.
  • Notify us immediately of any damage, malfunction, or issues.

5. Condition of Equipment

Equipment is delivered in good working condition. You are responsible for returning it in the same condition, normal wear and tear excepted. “Normal wear and tear” does not include damage from misuse, neglect, accidents, or failure to follow instructions.

6. Damage, Loss & Theft

You are fully responsible for any loss, theft, or damage to the equipment during the rental period, regardless of cause (except to the extent caused solely by the negligence of Houston Fan Rentals, LLC).

In the event of damage, loss, or theft:

  • You must notify Houston Fan Rentals, LLC immediately.
  • You are responsible for the cost of repair or the full replacement value of the equipment, plus any related recovery, transportation, and administrative costs.

7. Security Authorization

A Security Authorization is automatically added to your order at no charge at checkout. This authorization allows Houston Fan Rentals, LLC to charge your payment method after the rental for:

  • Damage to the equipment
  • Theft or loss of the equipment
  • Costs incurred if we are unable to collect the unit as scheduled
  • Other fees owed under these Terms

The Security Authorization is not a charge at the time of booking. Any actual charges will only be made if covered events occur, in accordance with these Terms.

8. Optional Accidental Damage Protection

If you select the optional Accidental Damage Protection add-on, it provides limited coverage for accidental damage that occurs despite normal use.

It does not cover:

  • Loss or theft
  • Damage caused by misuse or neglect
  • Damage from improper operation after instructions have been provided

This is a damage waiver offered by Houston Fan Rentals, LLC and is not an insurance policy issued by a third-party insurer. Full details are provided at the time of selection.

9. Payment & Fees

  • All rental fees, delivery fees, and optional add-ons are due at the time of booking unless otherwise agreed in writing.
  • Additional fees may apply for failed delivery/pickup attempts, excessive cleaning, damage, or other breaches of these Terms.
  • You authorize Houston Fan Rentals, LLC to charge the payment method on file for any amounts owed under these Terms.

10. Cancellations & Changes

  • Cancellations made more than 48 hours before the scheduled delivery date may be eligible for a full or partial refund at our sole discretion.
  • Cancellations within 48 hours of delivery, or failure to accept delivery, may result in forfeiture of rental fees.
  • Changes to dates or location are subject to availability and may incur additional fees.

11. Limitation of Liability

To the maximum extent permitted by law, the total liability of Houston Fan Rentals, LLC arising out of or related to the rental shall not exceed the total rental fees paid by you for the specific rental. We are not liable for any indirect, incidental, consequential, or special damages, including lost profits or business interruption.

12. Indemnification

You agree to indemnify and hold Houston Fan Rentals, LLC harmless from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the equipment, your breach of these Terms, or any injury or damage caused by the equipment while in your care (except to the extent caused solely by our negligence).

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Fort Bend County or Harris County, Texas.
